Step by step instruction on Hindu community liquidation

February 22, 2005 in answer to the Almaty Province Hakim Kulmakhanov Sh.K. inquiry the Chairman of Almaty Province Department of justice T. Onalbayev made practically step by step instruction on Hindu SKC commune liquidation.

It is stated in the letter: "...At present the materials of the case about confiscation of the plots are kept in the Karasai district court.

On December 24, 2004, the Karasai district court ruled that the illegally constructed buildings should be demolished. At the present moment the question of confiscating from M.A. Zhaksybekov a plot of land with the area of 15 ha, which is used contrary to its purpose, is considered.

Also the question of confiscating 30 summer plots in the Horticultural Association "Ptitsevod" of the Eltai village district of the Karasai district is considered as the plots are used contrary to their purpose: 11 summer plots are used by their owners as a hostel for the members of the RO "Society for Krishna Consciousness," 19 plots have not been developed or used for growing agricultural products for a number of years and become covered with weeds. At the present time the Department of Land Resources Management, requested by the Karasai district court, is preparing materials about the confiscation of the plots of land from each of the land-users separately.

There is no need to conduct additional checkups by the respective governmental bodies.

At the present moment we consider it practical to confiscate the plots of land thru the court...

...The mentioned facts form the ground for liquidation of the juridical person - the religious organization in our case, according to section 49 of the Civil Code of the Republic of Kazakhstan (general part).

The prosecutor's organs should initiate the liquidation of the juridical person thru the court."
